Sexual Assault Charges Dropped Against Actor Kevin Spacey
Prosecutors in Massachusetts dropped charges against American actor Kevin Spacey, who had been accused of groping a 18-year-old man at a resort island bar in 2016.
Court documents for the move indicate that the charges were dropped "due to the unavailability of the complaining witness." Spacey, in January 2018, had been charged with a single felony count of indecent assault and battery.
The dropped charges development comes days after Spacey's accuser refused to testify on the matter, instead pleading the fifth during a July 8 court hearing. The individuals had been ordered to testify about a cellphone he'd used on the night of the alleged assault. In addition to pleading the fifth, the accused failed to turn over mobile device to defense officials, instead stating that it's gone missing.
According to a criminal complaint, the alleged victim indicated that in July 2016 he came in contact with the "House of Cards" actor at a restaurant in Nantucket, Massachusetts. The accuser, who'd been working as a busboy at the time, told investigators that Spacey had groped him. During the alleged incident the then teenager reportedly took video of Spacey in the alleged act and sent them to his girlfriend via Snapchat.
Spacey, who is a two-time Oscar winner, has repeatedly denied the accusations.

A Cyprus police official says 12 Israelis have been detained after a 19-year-old British woman alleged that she was raped in the resort town of Ayia Napa.
The police official, who spoke on condition of anonymity because he's not authorized to speak publicly about an ongoing investigation, said Tuesday that it's still very early in the investigation and it's unclear how many of the suspects are implicated in the case.
The official couldn't say how the suspects knew the woman or whether they had been staying in Ayia Napa together as a group.
It's believed the suspects, all 17-18 years old, will appear in a Famagusta district court on Thursday for a custody hearing.
The Foreign Ministry has confirmed the arrests and the local Israeli envoy has been in touch with the suspects and their families.
Ayia Napa is very popular with younger tourists for its pristine beaches and vibrant night life.

These are just some of the allegations an anonymous plaintiff is making in a suit filed on June 18 against the Church of Scientology and its current leader, David Miscavige, 59. Jane Doe, who’s believed to be around age 40, is suing the church — which boasts a host of famous members, including Tom Cruise, John Travolta and Kelly Preston — for kidnapping, stalking, human trafficking, false imprisonment, libel, slander, invasion of privacy and intentional infliction of emotional distress.
“The Church of Scientology presents a facade to the outside world to disguise what, in reality, is nothing more than a cult built on mind control,” the lawsuit alleges. The controversial church denies all allegations of abuse. In response to Jane Doe’s suit, the church’s lawyers tell Us, “We are confident the lawsuit will fail. The church will vigorously defend itself against these unfounded allegations.”
The shocking suit has the potential to bring down the controversial religion and its seemingly untouchable leader — and expose the secrets its A-list followers may have been keeping for years. “Tom [Cruise] undoubtedly knows the stories about the church,” a source tells Us of Scientology’s celebrity golden boy. Another insider says that with the actor, 57, employed as Miscavige’s right-hand man and best friend, “there’s very little he doesn’t know. He and David are like brothers united in their religious devotion. If David is ordering this kind of harassment on people trying to leave the church,” adds the insider, “Tom would likely see it.”
Disturbing allegations against Scientology are nothing new. In the 2017 HBO documentary Going Clear: Scientology and the Prison of Belief, one former member recalls a “prison camp” where followers were allegedly forced to do hard labor for 30 hours at a time, eat table scraps and sleep on wet mattresses.
Leah Remini, who left Scientology in 2013, has since made it her mission to expose the church’s “physical and sexual abuse practices,” she’s said in August 2017 Opens a New Window. . Things aren’t looking good for the once-powerful organization. “The church is in crisis,” says Tony Ortega, a blogger who’s critical of Scientology. “Membership is dwindling, and its practices are being exposed in ways we’ve never seen before.” Scientology critic Steve Mango, of Mangotology.org Opens a New Window. , adds, “Scientology has been trying to cover up its crimes and abuse for decades,” he says. “This suit is the beginning of the unraveling of Scientology as we know it.”

Sources have since told the tabloid that Cruise, 57, a famous follower of the controversial religion, is incredibly involved in the sect and would know of any crimes transpiring inside of it.
“There’s very little he doesn’t know. He and David are like brothers united in their religious devotion. If David is ordering this kind of harassment on people trying to leave the church Tom would likely see it,” the insider said of the “Top Gun” actor.
While questions regarding Cruise’s possible involvement in a crime ring loom, the woman who filed the lawsuit in a California court described the Church of Scientology as a “cult built on mind control.” She also alleged that members were regularly subjected to physical, emotional, and sexual assault and that members who attempted to alert authorities were deemed “suppressive” and other followers are instructed to injure or destroy them, according to Radar Online.
Categorically denying claims levied in the lawsuit, a lawyer for the church told Us Weekly, “We are confident the lawsuit will fail. The church will vigorously defend itself against these unfounded allegations.”

She claimed members are subject to “physical, verbal, psychological, emotions and/or sexual abuse and/or assault.”

Is the Netflix juggernaut finally dead?
In retrospect, nobody was prepared for just how bad the final number would be, because moments ago while Netflix reported strong top and bottom line results, it was the collapse in Q2 subscriber growth that is the reason why the stock is plunging over 10% after hours, specifically Netflix reported that in Q2 it added a tiny 2.7 million subs, far below the company's 5.0 million forecast, below the Wall Street consensus estimate of 5.06 million, and the lowest increase in three years.
First the good news: EPS of 60 cents was above the 56 cents expected, with revenue of $4.92 right on top of the expected $4.93 billion. Additionally, the company reported a rather impressive Q1 EBITDA of $836 million, well above the $584MM in Q1. Of course, if that was the extent of it, NFLX stock would be surging. Looking ahead, Netflix reported that Q3 forecast revenue would be $5.250 8BN, a 31.3% increase Y/Y, which is also above the estimate of $5.2BN, a number which would generate EPS of $1.04.
However, the reason why Netflix is tumbling after hours is because just like one and two quarters ago, the growth story is once again in jeopardy as a result of the company's surprisingly weak subscriber print: to wit, whereas Wall Street expected Q2 subscribers to rise by 5.06 million, Netflix reported just half this number, or 2.70 million, which in addition to a far weaker than expected 2.825mm intl subs, domestic subs actually declined by 126K in Q2 to 60.1 million, a sharp slowdown from the 9.6 million paid net subscribers added in Q1.
Ironically, the company also said that it doesn't believe competition was a factor since there wasn’t a material change in the competitive landscape during Q2, and competitive intensity and our penetration is varied across regions." Which means just wait to see what happens with subs when competition does ramp up.
Instead, what Netflix is blaming the miss on is its "stale" Q2 content slate, which "drove less growth in paid net adds than we anticipated. Additionally, Q1 was so large for us (9.6m net adds), there may have been more pull-forward effect than we realized."
Netflix also refuses to publish it's Subscriber Acquisition Cost or SAC, abandoning this metric several years ago.
While we don't doubt the company's sincere optimism, the fact that it has now disappointed on current or projected subs for three quarters in a row suggests that something may be off with the company's growth model, and perhaps its recent eagerness to hike prices is coming back to painfully bite it in the ass.
Which brings up the question we asked last quarter: why did Netflix announce a price hike in late Q1, to which we bring up the answer provided by Anthony DiClemente last quarter, who was worried that the market is "pricing in perfection" and wondered if the real story behind the recent price increase is that the company sees revenue coming more from fee increases than subscriber growth, suggesting an end to the company's unbridled growth trajectory.
And then there was Netflix's Free Cash Flow, or rather Free Cash Inferno, which after modestly easing off in Q1 after exploding higher in Q4 of 2018, has once again started to rise, and in Q2 was $593 million, $35 million more than a year ago.
Meanwhile, as the company engages in a cash inferno, it once again plans to use high yield debt to fund its content investments as it did in April:
"In our most recent round, we raised 10.5 year senior notes of €1.2 billion (3.875% coupon) and $900 million (5.375% coupon)."
Which is somewhat odd, considering that in the last earnings report, CEO Hastings told debt investors that they “better get in soon” as the company looks to wind down its borrowing in the future. Looks like he was wrong about that too.
All things considered, the fact that NFLX has plunged as much as 12%, sending the stock to the lowest level since the start of the year.

Atwater Man Sentenced to 40 Years in Prison for Offenses Related to the Sexual Exploitation of Children Using Social Media
FRESNO, Calif. — Chief U.S. District Judge Lawrence J. O’Neill sentenced Nikko Adolfo Perez, 27, of Atwater, today to 40 years in prison, to be followed by a lifetime term of supervised release for his convictions for the sexual exploitation of children, coercion and enticement of a minor, and receipt and distribution of child pornography, U.S. Attorney McGregor W. Scott announced.
“While Perez's sentence is substantial, it pales in comparison to the lifetime of damage he inflicted upon his many victims. Innocence cannot be restored,” said Special Agent in Charge Sean Ragan of the FBI Sacramento Field Office. “We hope this case inspires families to have conversations about the danger of communicating online over text, apps, and other media with a stranger and the importance of immediately seeking help if communication becomes exploitive or threatening. The internet fosters both false familiarity and anonymity, which can empower a predator. We urge the community to be mindful of the inherent danger of communicating with or transmitting photos to someone you do not truly know.”
According to a criminal complaint, Perez, using the Instagram screen name captainamerica272018, victimized two boys, ages 8 and 10, in Utah by coercing them to create and send him images of themselves engaged in sexually explicit conduct. Perez offered to pay the boys with Google Play credits if they engaged in requested sexual acts or poses, and when one of the victims said he would call 911, Perez threatened to disseminate the sexually explicit images of the victims. He also threatened to harm family members of the victims.
Perez admitted in a plea agreement that he also used Skype, Kik, Discord, Snapchat, and LiveMe to communicate with between 50 and 100 minors for the purpose of soliciting sexually explicit images of those minors. He admitted that he persuaded the victims to pose nude or engage in sexually explicit activities, sometimes with other minors. He admitted that he often paid victims to engage in this conduct, and he sent some of the material that he had requested to other people.
The FBI continues to seek additional victims. Information can be submitted to https://tips.fbi.gov or call the local FBI office.
This case was the product of an investigation by the Federal Bureau of Investigation, the Salt Lake City Police Department, and the FBI’s Violent Crimes Against Children Section Major Case Coordination Unit. The Merced District Attorney’s Office investigations unit also assisted in the investigation of the case. Assistant U.S. Attorney David Gappa prosecuted the case.
This case was brought as part of Project Safe Childhood, a nationwide initiative launched in May 2006 by the Department of Justice to combat the growing epidemic of child sexual exploitation and abuse. Led by the United States Attorneys’ Offices and the Criminal Division’s Child Exploitation and Obscenity Section, Project Safe Childhood marshals federal, state, and local resources to locate, apprehend, and prosecute those who sexually exploit children, and to identify and rescue victims. Bail Bondswoman Sentenced to Three Years’ Imprisonment for Smuggling Hundreds of Aliens into the United States
Defendant Ordered to Forfeit Her Texas Residence, Two Hotels, $7.2 Million in Bail Bonds, $400,000 in Cash and 11 Gold Bars
Earlier today, in federal court in Central Islip, Hema Patel, a Texas-based bail bondswoman, was sentenced by United States District Judge Denis R. Hurley to three years’ imprisonment for her role in smuggling hundreds of illegal aliens into the United States. The Court also ordered Patel to forfeit her Texas residence, two hotels, $7.2 million in bail bonds, $400,000 in cash and 11 gold bars, among other assets. On June 7, 2018, Patel pleaded guilty to alien smuggling for financial gain by fraudulently bonding illegal aliens from immigration custody and causing their release into the United States.
Richard P. Donoghue, United States Attorney for the Eastern District of New York, and Angel M. Melendez, Special Agent-in-Charge, U.S. Immigration and Customs Enforcement, Homeland Security Investigations (HSI), New York, announced the sentence.
“For her personal financial gain, defendant Hema Patel arranged to have hundreds of aliens smuggled into the United States, completely by-passing the visa application and eligibility requirements,” stated United States Attorney Donoghue. “She will now pay the price for placing the safety and security of the residents of our communities at risk. Border security is a top priority of the Department of Justice.”
“In a classic example of how criminal networks exploit loopholes in our nation’s immigration system to make a profit while threatening the national security of the United States, Hema Patel and her human smuggling co-conspirators manufactured fraudulent bond documents to secure the release of undocumented aliens that were smuggled through the southwest border by an international criminal network,” stated HSI Special Agent-in-Charge Melendez. “HSI remains steadfast in its commitment to secure our nation’s legitimate travel, trade and finance by going after transnational criminal networks, their facilitators and their ill-gained assets.”
From April 2015 through October 2016, Patel and her co-conspirators executed a scheme to bring undocumented aliens, primarily from India, into the United States in exchange for “fees” ranging from approximately $28,000 to $60,000 per person. Patel and her co-conspirators paid middlemen, or “coyotes,” to arrange the logistics of the aliens’ travel, either a northern route through Canada, or a southern route through Mexico. When the aliens were stopped and taken into custody by law enforcement officers at the U.S. border, they called Patel. Patel then prepared fraudulent bond documents on their behalf, including documents listing fictitious names and addresses indicating where and with whom the aliens would reside while their cases were pending. These documents and the bail bonds were then filed in United States Immigration Courts, and the aliens were released into the community. Patel used two of her hotels in Texas to temporarily harbor some of the aliens.
On November 17, 2016, law enforcement agents executed a search warrant at Patel’s Texas residence, seizing thousands of fraudulent alien bonding records.
On November 30, 2017, Patel’s co-defendant Chandresh Kumar Patel (not related to Hema Patel) pleaded guilty to smuggling aliens for financial gain for his role in the scheme as an alien trafficker and financial broker. At the time of his arrest, law enforcement agents recovered $80,000 from his Queens residence. On October 5, 2018, Chandresh Kumar Patel was sentenced to three years’ imprisonment.
The government’s case is being handled by the Office’s Long Island Criminal and Civil Divisions. Assistant United States Attorneys Mark E. Misorek and Robert W. Schumacher are in charge of the prosecution.

Well, if you want a sneak peak of "the next season of Q," and the terms: "Tuzla Air Base," "Madeline Albright," and "Hassan Al Banna" don't ring much of a bell for you, then those are an interesting sequence of digs that relate back to some of Q's first posts.
